These Terms of Service ("Terms") govern your use of the OwnMyHotel platform. By accessing or using our services, you agree to be bound by these Terms.

1. Definitions

  • "Platform" refers to the OwnMyHotel software, including the web dashboard, guest app, staff app, and all related services.
  • "Customer" refers to the hotel or hospitality business subscribing to our services.
  • "End User" refers to hotel guests and staff who interact with the platform.
  • "Subscription" refers to the paid plan selected by the Customer.

2. Account Registration

  • You must provide accurate and complete information during registration.
  • You are responsible for maintaining the security of your account credentials.
  • You must be authorized to act on behalf of the hotel or business you register.
  • One account per hotel property. Multi-property accounts are available on premium plans.

3. Service Description

OwnMyHotel provides a cloud-based hotel management platform including booking engine, channel management, guest experience tools, staff operations, revenue intelligence, and analytics. Features available depend on your subscription plan.

4. Free Trial

We offer a 14-day free trial with no credit card required. During the trial, you have access to all platform features. At the end of the trial, you must select a paid plan to continue using the service. Data entered during the trial is preserved when you subscribe.

5. Payment Terms

  • Subscription fees are billed monthly or annually as per your selected plan.
  • Payments are processed through Razorpay, PayU, or Cashfree.
  • All fees are in Indian Rupees (INR) and exclusive of applicable taxes.
  • Failed payments may result in service suspension after a 7-day grace period.
  • You may upgrade or downgrade your plan at any time from your dashboard.

6. Data Ownership

You retain full ownership of all data entered into the platform, including guest records, booking data, and operational data. We do not claim any intellectual property rights over your content. You can export your data at any time.

7. Acceptable Use

You agree not to:

  • Use the platform for any unlawful purpose
  • Attempt to reverse-engineer, decompile, or disassemble the platform
  • Share account credentials with unauthorized third parties
  • Upload malicious code or attempt to compromise platform security
  • Use the platform to send spam or unsolicited communications
  • Resell or sublicense access to the platform without written consent

8. Service Level

  • We target 99.9% platform uptime, excluding scheduled maintenance.
  • Scheduled maintenance will be communicated at least 24 hours in advance.
  • We provide 24/7 customer support via email and chat.
  • Critical issues are addressed within 4 hours; non-critical within 24 hours.

9. Termination

  • You may cancel your subscription at any time from your dashboard.
  • Upon cancellation, your access continues until the end of the billing period.
  • We may suspend or terminate accounts that violate these Terms.
  • After termination, you have 30 days to export your data before it is deleted.

10. Limitation of Liability

OwnMyHotel is provided "as is". To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the platform. Our total liability shall not exceed the fees paid by you in the preceding 12 months.

11. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email at least 30 days before they take effect. Continued use of the platform after changes constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Noida, Uttar Pradesh.
